By accessing or using Encore Alert, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the service.
The service
Encore Alert helps users discover concerts, organize watched events, record ticket-related information, and receive selected alerts. Features may change, be added, or be removed as the service develops.
Accounts
You are responsible for providing accurate account information, protecting your password, and maintaining control of your devices. Notify us promptly if you believe your account has been accessed without permission. You may delete your account from the Account screen.
Concert and ticket information
Event dates, venues, availability, sale times, prices, fees, and other details can change. Encore Alert does not sell tickets and cannot guarantee that third-party information is complete, current, or error-free. Always confirm important details with the official venue, artist, or ticket provider before purchasing tickets or making travel plans.
Price guidance
“Buy Now,” “Wait,” target-price, and similar guidance is informational only. It is based on available event information and information you record in the app. It is not a promise of future prices, availability, savings, or resale value, and it is not financial advice.
Third-party services
Encore Alert may display information from or link to Ticketmaster, maps, venues, and other third parties. NimbleBeacon Labs is not responsible for third-party content, inventory, transactions, refunds, policies, or services. Your use of a third-party service is governed by that provider’s terms and privacy policy. Encore Alert is not endorsed by or affiliated with Ticketmaster unless expressly stated otherwise.
Acceptable use
You agree not to:
- use the service unlawfully or to harm others;
- interfere with the service, its security, or another user’s access;
- attempt unauthorized access to accounts, systems, or data;
- use automated means to scrape or overload the service; or
- copy, reverse engineer, or exploit the service except where applicable law permits it.
Ownership
Encore Alert, its design, software, and original content are owned by NimbleBeacon Labs or its licensors and are protected by applicable intellectual-property laws. Third-party names, marks, event data, and content remain the property of their respective owners.
Availability and termination
We may modify, suspend, or discontinue all or part of the service. We may restrict or terminate access when reasonably necessary to protect the service, users, or third parties, or when these terms are violated.
Disclaimers
To the fullest extent permitted by law, Encore Alert is provided “as is” and “as available,” without warranties of uninterrupted operation, availability, accuracy, fitness for a particular purpose, or non-infringement. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, NimbleBeacon Labs will not be liable for indirect, incidental, special, consequential, or punitive damages, or for losses arising from ticket purchases, price changes, missed alerts, event changes, travel plans, third-party services, lost data, or inability to use the service. Rights that cannot legally be limited remain in effect.
Changes to these terms
We may update these terms as Encore Alert changes. Continued use after updated terms become effective means you accept them. Material changes will be identified by a revised effective date.
Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except where consumer-protection law requires otherwise.
